Terms of Service (EULA)

1. Introduction

This End User License Agreement and Terms of Service ("Terms") govern your access to and use of the Yamy application and related services ("Service"), provided by Helihool Tech OÜ ("Company", "we", "our", or "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service. You must be at least 16 years old (or the age of digital consent in your country) to use Yamy.

2. Subscriptions and Billing

Yamy may offer subscription plans with recurring fees billed monthly or annually ("Subscription"). Prices, features, and availability may vary by region and platform. Taxes may apply.

• Fees are charged to your payment method via the app store or our payment processor.
• Your Subscription renews automatically unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your Subscription in your account settings or through your app store.

3. Free Trials

We may offer a free trial. If you do not cancel before the trial ends, your Subscription will convert to a paid plan and the applicable fee will be charged automatically.

4. Cancellation and Refunds

You may cancel your Subscription at any time. You will retain access until the end of the current billing period.

• Refunds are handled by the platform used for purchase (e.g., Apple App Store, Google Play, or our payment provider) and are subject to their policies.
• Where required by law, you may be entitled to a refund. Contact support for assistance.

5. License Grant and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

• Do not copy, modify, reverse engineer, or attempt to extract source code, except as permitted by law.
• Do not use the Service in any unlawful, harmful, or abusive manner.
• All rights not expressly granted are reserved by the Company.

6. Acceptable Use

• Do not upload content that is illegal, harmful, or infringes the rights of others.
• Do not interfere with or disrupt the Service, networks, or security features.
• Do not attempt to access accounts or data without authorization.

7. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

8. Content and Data

You retain ownership of content you submit to the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content for the purpose of operating and improving the Service.

9. Third-Party Services

The Service may integrate with third-party platforms and providers (e.g., app stores, Strava, payment processors). Your use of those services is subject to their terms and privacy policies.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in fraudulent or harmful behavior, or as required by law. Upon termination, your license ends immediately.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim shall not exceed the amounts you paid for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia, without regard to its conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Estonia, unless applicable consumer protection laws provide otherwise.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated within the app or via email where appropriate. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
